Torrance, Expungement of Hermosa Beach PC 415 Conviction

In January 2019, our client, then 28 years old, was arrested on suspicion of public intoxication (Penal Code § 647(f)) by the Hermosa Beach Police Department.

The arrest arose from an incident in Hermosa Beach when the client allegedly knocked repeatedly on someone’s front door on a home on Hermosa Avenue that was not his own.  No one answered the door, but the occupant called the police, who responded and found our client nearby.  The client explained that he had consumed two Long Island Ice Teas.  Because police thought our client was quite intoxicated, the police arrested him and took him to the station to dry out.  He was later released after signing a promise to appear in the Torrance courthouse in about three months.

At the time, our client was two years into informal probation on a DUI conviction out of the Newport Beach courthouse.

At the Torrance Courthouse, our office represented the client, eventually reaching a resolution wherein the client entered into a plea bargain to a violation of Penal Code § 415 (disturbing the peace) in June 2019.  The charge of public intoxication was dismissed.  This was negotiated to avoid a probation violation for the client in the Newport Beach case.

The terms of the plea bargain were that our client was placed on one year of summary probation on the following terms and conditions: payment of a court fine of $150, plus penalties and assessments (total of $220); serve one day in county jail (credit for time served), stay away from the home on Hermosa Beach Avenue, attend 10 Narcotics Anonymous or Alcoholics Anonymous meetings and pay a booking fee ($358) to City of Hermosa Beach.   

The client then complied with all terms and conditions of probation and probation terminated naturally after a year in June 2020.  

In 2024, due to pressing employment concerns, our client, now 33 years old, called up Greg Hill & Associates about expungement.  The client was working as a technical writer for a large magazine publisher.  He was now married with a child expected in a few months.  The client wanted to earn more money and was interested in knowing if expungement would help him.  He had applied for some other similar jobs and had been denied employment because of his criminal history, he was told.

Greg explained that our office certainly could prepare, file and serve such a petition for the client.  Greg also explained that expungement does not delete the conviction or erase the case from one’s criminal history.  Instead, it restores one’s original not guilty plea to the charge and the case is shown as dismissed (not convicted).  Greg explained that the main benefit of expungement is that it legally allows the client to deny the conviction took place, if asked, with certain exceptions that Greg explained.  

The client then hired Greg Hill & Associates to prepare the petition, file it in the Torrance Courthouse and serve it to the Redondo Beach City Prosecutor’s office, who prosecuted the case for the City of Hermosa Beach.

The petition included a short memorandum of points and authorities about the facts of this case, the court’s power under Penal Code § 1203.4, and a short explanation about why the client requested expungement, supported by a declaration from the client signed by him.  The declaration explained how our client, now 33 years old, was committed to living in a positive, productive direction.  He had lived a stable life since this conviction and worked hard to never to make the kinds of mistakes that led to the conduct at issue.  

The declaration explained that our client was denied employment and job opportunities while having a conviction for Penal Code § 415.  This was having a crippling impact on his professional life.  He did not want to keep paying for his mistake.  

The judge assigned to the petition at the Torrance Courthouse granted the petition, which made our client very happy.
