Sometimes, the probation violation is out of a separate courthouse, so coordinating the two cases to avoid duplicative or redundant punishment is vital. Often, when the two cases are out of different courthouses, we will seek to transfer the new case to the courthouse handling the probation violation, or visa versa to the courthouse handling the new violation. If a probationer on felony or misdemeanor probation has failed to complete a condition of probation, he faces substantial jail or prison time. It is therefore critical that you have an experienced criminal defense attorney at your side.

Often, there are reasonable explanations as to why a condition of probation was not completed. If the probationer was ill, family was ill, unforeseeable work obligations and lack of money are all reasonable explanations for failing to meet the conditions of probation. However, only a skilled defense attorney can persuasively argue these points and obtain documentation and verification that will satisfy the court.

If the probation department seeks to violate your probation, it is absolutely critical that you ask the court to hear your side of the story before the probation department has violated your probation and sought a warrant for your arrest. If the probation department has already requested the warrant or if there is an outstanding warrant, it is equally as critical that you contact an attorney who can ask for a court hearing before you are arrested on the warrant. If you show up in court before being arrested, you have a much better chance of successfully defending the probation violation.

If the conditions of probation are causing an undue hardship on the probationer, your defense attorney can successfully argue for a modification of probation under Penal Code § 1203.3(a), or in some circumstances, early termination of probation.

Other times, a probation violation arises from the client’s failure to obey all laws because the client is arrested on a new offense. In such circumstances, our office must defend the client on two fronts, both as to violating probation and on the new offense. If the new offense ends in dismissal, the probation violation is resolved as well. Therefore, it is extremely important to hire an experienced criminal defense attorney on the new offense to ensure your best chances of having the probation violation resolved by dismissal.
