Banning Police Department
If a family member, you or a loved one have been arrested by or are being investigated by the Banning Police Department, it can cause a lot of worries, mostly just from uncertainty of what will happen or can happen. Moreover, one is dependent upon the accuracy, competence and honesty of a police officer, who may or may not be experienced or have the same sense of urgency as you in having the police report properly written.
Facing such a situation, knowing the bail amount (if any) associated with the offense or offenses at issue if police deny an own recognizance (OR) release may ease one’s angst. It is also prudent to know what evidence is needed to convict one for the crime or crimes that allegedly took place, the defenses possible and the sentence a judge can impose if one is convicted of the crime or crimes.
We at Greg Hill & Associates believe it is smart to know a few more things before interacting with any branch of law enforcement. It can be wise to know the size of the police or sheriff’s department, the area’s demographics, a bit of history about the town, city or area, the most common types of crimes the department investigates and just a bit about the area’s history to make one’s communication with law enforcement more meaningful, more savvy and perhaps, more respectful. This can lead to a better outcome than if one lacks such perspective.
This article is presented with these goals in mind.
The Banning Police Department is a small force, with just thirty-three sworn police officers and twelve civilian support personnel assigned to it. The Banning Police Department is responsible for patrolling the City of Banning, which is 23.24 square miles and has a population of 29,505 as of the 2020 census.
For arrests along the freeways crossing Banning such as the I-10, the California Highway Patrol (CHP) will normally handle this work, although one may be thereafter transported to the Banning Police Department for processing, a breath test (if a DUI) and booking. The person may also be held at the Larry D. Smith Correctional Facility (in Banning) until bail is posted or the person is transferred to the Riverside County Jail in Riverside.
As of 2010, the city’s population was 43.4% non-Hispanic white, 5.2% Asian, 7.3% African American and 41.1% Hispanic.
Banning is traversed by the San Andreas Fault which created the pass in which the city is situated. The city sits at 2,300 feet, so it is a bit cooler than nearby Palm Springs, which is twenty-five miles away.
Most cases arising out of the Banning Police Department’s areas of responsibility are brought at the Banning Courthouse, but some are also brought at the Riverside Hall of Justice at 4100 Main Street in downtown Riverside. Cases that may be filed at the Riverside Hall of Justice instead of at the Banning Courthouse would be very serious cases needing specialized prosecutors trained in handling such cases.
The Banning Courthouse is a newer courthouse with modern architecture and high ceilings.
Over the last 25-plus years, our office has handled perhaps ten cases out of the Banning courthouse, which have included DUI, shoplifting at the nearby outlet stores, a serios evading arrest and probation violation case and a domestic violence case.
In one of our more memorable cases, we represented a tourist from Northern California who was staying in Palm Springs with her husband for a few days of vacation. While he was enjoying golf, she went to the outlet stores at Cabezon and got caught for shoplifting not just once, but twice in one day. She was chased on foot around the parking lot in the second case. We were fortunate enough to have both cases dismissed, which was good for our client’s employment situation.
We find that locals to the Banning area often distrust local criminal defense attorneys as being friends with prosecutors, so they are unwilling to fight too hard, so we are hired instead because we have no such ties or loyalties.
